OODLE – TERMS OF USE

1. ACCOUNT ELIGIBILITY & RULES

To create an account, you must:

1. Be at least 18 years old, or the age of majority in your jurisdiction.
2. Be legally permitted to use the Service in your country.
3. Use your real age and real identity.
4. Maintain only one account unless explicitly authorized.

We monitor for underage accounts and may suspend, restrict, or delete accounts believed to be underage or ineligible.

You may register using manual sign-up or third-party login credentials (e.g. Google, Apple). By doing so, you authorize us to access information from those platforms subject to our Privacy Policy.

You are responsible for all activity on your Account.
Sharing your account with others is prohibited.

You may delete your Account at any time through the App settings.

2. CONTENT ON OODLE

There are three types of content on the App:

1. Your Content – content you upload (photos, videos, text, messages, etc.).
2. Member Content – content uploaded by other users.
3. Our Content – everything owned or licensed by Oodle (software, design, trademarks, UI, etc.).

2.1 Prohibited Content & Behavior

You agree not to upload, share, or engage in content that:

• Breaks any law or promotes illegal activity.
• Harms or endangers minors.
• Involves scams, fraud, impersonation, or deceitful behavior.
• Is defamatory, abusive, harassing, violent, pornographic, or hateful.
• Promotes racism, sexism, extremism, or discrimination.
• Violates privacy or intellectual property rights.
• Involves non-consensual imagery.
• Contains malware, spyware, or harmful software.
• Involves spam, commercial advertising, or solicitation.
• Violates our Community Guidelines in any way.

We may remove content or restrict accounts at our sole discretion.

2.2 Your Content – Rights & Responsibilities

You represent and warrant that:

• You own or have rights to Your Content.
• Your Content does not break any laws or violate any rights.

By posting Your Content, you grant Oodle a worldwide, perpetual, non-exclusive, royalty-free, transferable, sublicensable license to use, modify, store, reproduce, distribute, display, create derivative works from, and otherwise use Your Content for operating, promoting, and improving the Service.

We have no obligation to store Your Content.

You will indemnify, defend, and hold harmless Oodle from claims related to Your Content.

2.3 Member Content

Other users' content belongs to them. You may not:

• Copy, distribute, or exploit Member Content.
• Use Member Content for harassment, threats, or commercial purposes.

We may remove Member Content at any time.

2.4 Our Content

Oodle owns all rights to the App and its materials.

We grant you a limited, personal, revocable, non-transferable, non-sublicensable license to use the App for personal use only.

You may not:

• Copy, sell, modify, decompile, reverse engineer, scrape, or exploit Our Content.
• Use bots, crawlers, scripts, or automated tools without our written permission.

We reserve all rights not expressly granted to you.

3. SAFETY, SCAMS & USER RESPONSIBILITY

3.1 Interactions Are 100% Your Responsibility

You are solely responsible for:

• Your communications with other users.
• Your decisions to meet users offline.
• Any money or information you share with other users.
• Moving conversations outside the app (WhatsApp, Telegram, Instagram, etc.).
• Any harm, loss, or injury resulting from interactions.

3.2 No Liability for Scams, Fraud, or Offline Harm

To the maximum extent permitted by law, Oodle is not liable for:

• Romance scams, financial scams, crypto scams, catfishing, or deceptive behavior.
• Harassment, threats, emotional harm, extortion, or blackmail.
• Any injuries, damages, or losses arising from offline meetups.
• Any harm resulting from users urging you to switch to other apps.
• Any misconduct by users, online or offline.

Oodle does not guarantee safety, compatibility, or authenticity of any user.

3.3 Release of Claims

To the fullest extent permitted by law, you release and forever discharge Oodle Group from:

• Any claims, damages, losses, or demands arising from your interactions with other users.
• Any misconduct, actions, or omissions by users you meet through the App.

Except where prohibited by law, this release applies to all claims, known and unknown.

4. COLORADO SAFETY POLICY

(Required because your Terms incorporate Bumble's safety standards for Colorado users)

For users residing in Colorado, Oodle additionally prohibits:

• Any content or behavior involving public safety threats, violence, unlawful sexual behavior, kidnapping, stalking, harassment, or similar.

Oodle may investigate user misconduct and may, where necessary:

• Restrict accounts
• Remove content
• Warn users
• Ban users
• Cooperate with law enforcement

Past or offline misconduct may result in account action.

Users may appeal account actions within six months.

5. PRIVACY

By using Oodle, you consent to our data practices.

6. PAYMENTS, SUBSCRIPTIONS & REFUNDS

Purchases may be made through:

• Google Play
• Apple App Store
• Other authorized payment providers

Subscriptions Auto-Renew

Subscriptions renew automatically unless canceled before the renewal date.
Deleting the App does not cancel your subscription.

Refunds

Refunds are provided only where required by law or explicitly offered by the relevant payment platform (Google/Apple).

• Refunds for Apple purchases must be requested from Apple.
• Refunds for Google purchases (outside the US) must be requested in Google Play.

Oodle itself does not guarantee refunds.

7. VIRTUAL ITEMS

Boosts, Sparks, badges, and similar items ("Virtual Items") have no cash value, are non-refundable, non-transferable, and not redeemable for money.

All purchases of Virtual Items are final.

Unused Virtual Items are forfeited upon account termination.

8. NOTIFICATIONS & LOCATION SERVICES

Oodle may send emails, SMS, push notifications, and alerts related to the App.

You may control notification settings in your device settings.

Oodle may use your location to show nearby users or features.

9. DISCLAIMER OF WARRANTIES

To the maximum extent allowed by law, the App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including:

• Fitness for a particular purpose
• Compatibility
• Safety of matches
• Accuracy or reliability
• Uninterrupted or error-free access

Your use of the App is entirely at your own risk.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• Oodle Group is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including:
  • Loss of money
  • Loss of data
  • Loss of profits
  • Loss of goodwill
  • Emotional harm
  • Physical harm resulting from user interactions

This liability cap applies in aggregate across all claims.

Nothing limits liability where such limitation is prohibited by law.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Oodle Group from claims arising out of:

• Your use of the App
• Your Content
• Your interactions with other users
• Your breach of these Terms
• Your violation of any laws or third-party rights

We may assume exclusive defense of any claim.

12. COPYRIGHT / DMCA

If you believe your copyrighted work has been infringed on Oodle, contact us at:

Include:

• Your full name, address, and contact information
• Description of the copyrighted work
• Location of the infringing content
• A statement of good-faith belief
• A statement under penalty of perjury
• Your signature (digital acceptable)

We may remove or disable access to content.

13. THIRD-PARTY INTEGRATIONS

If you downloaded Oodle from the Google Play Store or Apple App Store, their terms also apply.

These platforms are not responsible for:

• Supporting Oodle
• Any legal claims related to Oodle
• Handling refunds (unless governed by their own policies)

14. DISPUTE RESOLUTION & ARBITRATION AGREEMENT

14.1 Informal Resolution First

You must email Oodle at hello@oodle.social and attempt informal resolution for at least 30 days before initiating arbitration or legal action.

14.2 Binding Arbitration (Except Where Prohibited)

To the maximum extent permitted by law, you agree that:

• All disputes will be resolved by binding individual arbitration, not court.
• No jury trial, no class action, no collective or representative action.
• Arbitration will occur under Indian law unless prohibited.
• Small claims matters may be brought in court individually.

14.3 Class Action Waiver

You waive the right to participate in any:

• Class action
• Class arbitration
• Representative action

14.4 Mass Arbitration Protocol

This section mirrors Bumble's mass-filing rules:

• If 30+ similar claims are filed, special batch processing applies.
• Bellwether cases are selected.
• Filing fees for non-bellwether cases are paused.
• Global mediation may occur after the bellwethers.
• Remaining cases may be handled in batches of 100.

14.5 Governing Law & Venue

Except where restricted by mandatory law:

• These Terms are governed by the laws of India.
• Any non-arbitrable disputes must be brought exclusively in the courts of Mumbai, Maharashtra, India.

15. TERMINATION

You may delete your Account at any time.

We may suspend or terminate your Account for:

• Violations of these Terms
• Unsafe or harmful behavior
• Suspicious activity
• Abuse or fraud
• Inactivity
• Any reason we deem appropriate

Termination does not entitle you to a refund.

Sections intended to survive termination (liability, indemnity, arbitration, etc.) remain in force.

16. MODIFICATION OF TERMS

We may update these Terms from time to time.

Continued use of Oodle after changes means you accept the updated Terms.

17. MISCELLANEOUS

• These Terms constitute the entire agreement between you and Oodle.
• If any section is invalid, the rest remain effective.
• Failure to enforce a provision is not a waiver.
• You may not assign your rights; we may assign ours.
• The English version controls in case of conflict.
